This website www.casamontalbano.it (hereinafter the "Site") is owned by Casa Montalbano S.r.l., with registered office in c.da Castellazzo S.S. 188 km 89 92017 - Sambuca di Sicilia (AG).

Casa Montalbano S.r.l. observes the regulations on contracts concluded at a distance set forth in Articles 50 et seq. of Legislative Decree 206/2005.

Please read the conditions below carefully, and print and/or save them on a high durable medium of your choice.

1) General Conditions.

All methods of sale, delivery and payment are listed in detail in the various sections of the Site and are to be considered an integral and substantial part of this contract. The terms and conditions applicable to each individual order will be those set forth on the Site at the time the order is placed. Any new terms and conditions will be effective upon posting on the Site and will apply only to sales concluded thereafter.

2) Offer to the public.

All products and prices shown on the Site constitute an offer to the public subject to the limitations and terms contained in the Site itself and in these terms and conditions.

3) Products

The appearance of the products delivered may not coincide with that represented on the Site in the event that the manufacturer has modified the packaging and therefore for reasons beyond the control of Casa Montalbano S.r.l. Information and ingredients reported refer to the date of online publication of the article - before consumption it is advisable to check the package physically received. If you wish to know the exact expiration date of a particular item based on the lots available at the time of purchase, please request it by sending an email to info@casamontalbano.it.

4) Prices

Only the price (per unit of measurement Euro/Kg for variable weight products and per package for all other products) calculated at the time of the order will be applied to the Customer's expenditure, without any consideration of price increases or decreases, including for promotions, which may have occurred subsequently or have been previously concluded. All prices are inclusive of VAT.

5) Acceptance of orders

The order sent by the Customer will be binding for Casa Montalbano S.r.l. only if the entire order process has been completed regularly and correctly without any highlighting of error messages by the Site. Casa Montalbano S.r.l. will not include in the shopping products not expressly ordered by the Customer.

6) Order Confirmation.

In his mailbox the Customer will receive confirmation of the order placed with a summary of the products, their prices, and the general and particular conditions applicable to the order.

7) Cancellation and modification of the order

Casa Montalbano S.r.l., as a result of unforeseen logistical and organizational difficulties, may cancel the order by giving notice by e-mail to the Customer or, subject to agreement with the same, change the day and/or time of delivery.

8) Delivery

For any anomaly found, the consumer may contact Casa Montalbano S.r.l. directly at the references indicated in the Contact Area of the site. Casa Montalbano S.r.l. will not be responsible for any delays occurring during transport.

Likewise, Casa Montalbano S.r.l. cannot be held responsible for any loss, damage, wrong or non-delivery caused by events and/or causes of force majeure or fortuitous events, such as but not limited to: natural disasters, adverse weather conditions (such as heavy snowfall), any strikes (of its own or other employees), accidents to means of transport, explosions, or any other cause, similar or different.

9) Products available and limitations to purchase

Casa Montalbano S.r.l. will not be in any way responsible for the temporary or permanent unavailability of one or more products. In case of unavailability, even temporary, of the products requested, Casa Montalbano S.r.l. undertakes not to charge the Customer the corresponding price. The site highlights the cases in which restrictions apply to the purchase of individual products.

10) Non-Delivery.

Delivery requires the presence of the Customer or his/her designee at the address and time specified in the order. If the Customer (or the person in charge) is not present a second delivery attempt will be made and a storage case will be opened. The costs of storage at the shipper's warehouse will be borne by the buyer. Casa Montalbano S.r.l. undertakes, in case of failure to collect by the deadline at the warehouse, to refund the purchase price to the buyer net of any costs of storage and shipping. in case of failure to collect defined Casa Montalbano S.r.l. will not refund the cost of delivery and that of the products. It will also be the right of Casa Montalbano S.r.l. to exclude the Customer from the service.

11) Payment

The purchase can be paid by the Customer at his/her choice by the following methods:

In the reason for the transfer, indicate the order number indicated in the order report e-mail and consider that the order will be processed only upon actual visibility of the deposit on the bank account (timing varies from bank to bank).

Please note that orders must be settled within one week of order confirmation or they will be cancelled.

PAYPAL: Concluding a purchase with this type of payment will display a page on the PayPal site where you can enter your personal e-mail address and password for your PayPal account, or access the procedure for creating a new PayPal account. After registration, you can proceed with payments via PayPal without having to re-enter your data, even for subsequent purchases. By choosing this payment method, the amount is charged directly to your PayPal account. PayPal protects the buyer's information.

A confirmation e-mail from PayPal will be sent with each transaction made using this method. The amount of the order will be charged to the PayPal account when the order is taken. In case of cancellation the amount will be refunded to the customer's PayPal account.

Payments are accepted only from users registered on the Italian PayPal site.

12) Right of Withdrawal

Customer rights are protected by Legislative Decree 206/2005 updated with the provisions of Legislative Decree 21/2014

Customer has, therefore, the right to withdraw from the contract, even partially, without explanation and without charge, provided that the withdrawal is communicated by registered letter A / R to Casa Montalbano S.r.l. c.da Castellazzo S.S. 188 km 89 92017 - Sambuca di Sicilia (AG), within 14 calendar days from the day of receipt of the products. The communication may be anticipated, within the same period, by e-mail, fax or telegram, provided that it is confirmed by registered A/R within the next 48 hours. Such communication must specify the will to withdraw from the purchase and the product or products for which it is intended to exercise the right of withdrawal, attaching a copy of the invoice.

If, on the other hand, delivery has already taken place, the consumer must send to the same address indicated above at his or her own expense the products that he or she intends to return, again within fourteen working days from the date on which he or she received the products, with the wording "return order" affixed to the package. The acceptance of the post office or shipper will be used to verify compliance with the deadline. Will not be withdrawn under any circumstances parcels cash on delivery or freight collect .The customer must then return the product at his own expense in the following ways: shipment by parcel post or express courier addressed to Casa Montalbano srl, c.da Castellazzo S.S. 188 km 89 92017 - Sambuca di Sicilia (AG).

If the withdrawal will have been exercised in accordance with the procedures described, Casa Montalbano S.r.l. will refund the amount paid for the purchase of the product as soon as possible and in any case within 30 calendar days from the date on which Casa Montalbano S.r.l. became aware of the exercise of the right of withdrawal by the Customer.

However, in the event that the products do not possess the essential characteristics promised, have manufacturing defects, there have been errors in the delivery of the same or in any case it is a cause attributable to Casa Montalbano S.r.l., the shipping costs for the delivery of the products purchased and any cash-on-delivery fee will also be returned.

The right of withdrawal is not allowed in the case of:

purchase of sealed packaged products, opened by the Customer; of goods that by their nature cannot be returned or are likely to deteriorate or alter rapidly (e.g. fresh and perishable food products);

13) Privacy

Casa Montalbano S.r.l. will proceed to the processing of the Customer's personal data in compliance with privacy regulations as specified in detail in the information in the Privacy section of the Site.

14) Jurisdiction

Any and all disputes that may arise in relation to the application, interpretation and execution of these general conditions of sale, will be imperatively devolved to the judge of the competent court of Sciacca.
